1.- APPLICABLE REGULATION:

This electronic contract is celebrated under Spanish law and specifically under the legal regime imposed by Law 34/2002 on Services of the Information Society and Electronic Commerce (LSSICE). The electronic contract will not be filed by a third party and the language for its conclusion is Spanish. These general conditions can be stored and reproduced at any time by the user who makes a purchase through the options of your browser and must be accepted before proceeding to pay for the products.

All NAKART ILUSTRACIONES products are exclusive and only for sale through the following on-line platforms: official store www.nakart.es, additional external store Etsy of NAKART ILUSTRACIONES and additional external store Aliexpress of NAKART ILUSTRACIONES. 

NAKART ILUSTRACIONES works upon request, so makes each requested product in a unique and personalized way and working in every detail to obtain the best result.

From the preview of the product(s) image(s) shown in the catalog to the presentation of the final product(s), the chromatic range of the illustrations may be slightly altered due to the calibration of each user's monitor. This is a minimally appreciable factor in the final product(s) thanks to the profile conversion systems made by NAKART ILUSTRACIONES.

It´s essential to follow the washing and drying methods indicated on the labels of the physical products and on the tabs of the same on this platform. Thus the material of the products and the stamped illustrations have a long durability over time. 

2.1. T-shirts:

NAKART ILUSTRACIONES Unisex T-shirts are 100% original and these are presented in black and white colors. These are 100% cotton and the application of our exclusive illustrations on them are made using the latest technology in DTG printing (direct to garment printing), which gives the final product greater resistance and durability against their use and washes. Taking care of these factors, we´ve at our disposal various recognized textile brands to make the final product: Roly, Sol's, Setas Cotton Crop and B & C.

The size of the illustrations applied in the final product may vary slightly depending on the size chosen by the customer.

The size of the illustrations on the T-shirts shown in the images of the product gallery is an example orientation.

Both the sizes and the colors presented in the models shown in NAKART ILUSTRACIONES are available based on the information provided by the textile supplier to NAKART ILUSTRACIONES. In case of the textile supplier informs NAKART ILLUSTRATIONS that a color and/or size selected by the customer, is not in stock, the customer will be informed by offering the following options: change to one of our additional textile brands with which we certify the same quality and results, to select another color and/or size, delay the order until it will be in stock or cancel the order.

2.2. High Quality print posters:

All NAKART ILUSTRACIONES HQ print posters have high quality print. All are presented on satin photo paper and depending on the product size, the paper grammage may vary between 200 g/m2 and 250 g/m2.

The final product is designed for interior decoration and the size shown in the images of the environments is an example orientation.

2.3. Vintage Tote Bags · Mugs:

NAKART ILUSTRACIONES Vintage Tote Bags and Mugs present their applied illustrations using the sublimation printing technology, which gives the final products greater resistance and durability against their use and washes.

3.- PRICES:

All product prices are indicated in euros and 21% tax included.

NAKART ILUSTRACIONES adds 5 Euro cents for each product purchased by the customer as a symbolic commission due to PayPal rates in its payment processing management.

4.- SHIPPING COSTS:

All shipping costs are indicated in euros and 21% tax included. The shipping costs are charged to the customer and are free for amounts over 100 €.

Send an order as a gift:

There is the possibility of send an order as a gift with the option to add a personal note. This service is free and valid in any of the carriers without affecting their deadlines. This service will appear in the #4 section (Shipping) of the order process in the Shopping cart.

5.- PAYMENT METHODS:

PayPal secure payment gateway:

Payment method available for all countries in the world.

The customer can pay via PayPal, with or without a registered account in said platform.

Credit card payment in NAKART ILUSTRACIONES is made through Paypal secure payment gateway, so NAKART ILUSTRACIONES never collects or manipulates any customer data related to its card, thus offering maximum security.

The cards currently supported by the Paypal secure payment gateway are: Visa, Mastercard, Maestro, American Express, Discover and Aurora.

6.- ESTIMATED DELIVERY TIME:

The order begins to be managed once NAKART ILUSTRACIONES reports to the customer by e-mail the payment viewed. After the moment of payment, it is not possible to cancel the order.

The delivery is made to the postal address that the customer has supplied. In case of confusion or little concreteness in the postal address provided, NAKART ILUSTRACIONES will contact the customer to corroborate this information and avoid possible incidents.

If an order whose content contains different products (for example, a T-shirt and a Mug), the delivery time of the order will be subject to the product whose estimated longer time (in this case, the T-shirt).

NAKART ILUSTRACIONES is not responsible for possible delays due to force majeure causes, such as customs, border protections, adverse weather conditions and the current COVID-19 pandemic situation.

6.4. Incidents at the time of delivery:

The customer is absent at the time of delivery of his order:

The carrier will notify the customer that his order is available for to be picked up at the post office closest to his home. If from then and during the course of the first days, the customer has not come to pick up his order to said post office, NAKART ILUSTRACIONES will contact him to notify him again.
If the order has not been picked up at the post office by the customer within a period of 14 days (this period may vary depending on the country of delivery), the carrier will return it to the recipient. The customer will have the opportunity to request to NAKART ILUSTRACIONES the resend of his order to the same delivery address, again paying the same shipping costs.

The delivery address of the customer is incorrect or does not exist:

NAKART ILUSTRACIONES or the carrier will contact the customer to clarify the incident and correctly deliver the order. In case of not being able to contact the customer to resolve the incident, the carrier will proceed to return the order to the recipient. The customer will have the opportunity to request to NAKART ILUSTRACIONES the resend of his order to the corrected delivery address, again paying the same shipping costs.

7.- RETURNS REQUEST (RMA):

In accordance with Spanish legislation, the customer may return the received product(s) if it proves that it does not meet its expectations. The customer should know that the products shown on-line are as accurate a representation as possible of the final products (ref. #2.- Products).

The exercise of the right of return request will have to be made within a maximum period of FOURTEEN calendar days from the moment the customer has received the package. To exercise this right, the product(s) must be in the state in which the original packaging was received and kept. In addition, the customer must attach the corresponding return order document that can download from NAKART ILUSTRACIONES account once NAKART ILUSTRACIONES has accepted the return request.

In case of not fulfilling the aforementioned conditions, NAKART ILUSTRACIONES reserves the right to refuse the return request.

In case of not fulfilling the aforementioned conditions, the refund of the purchase amount will be made with the same payment method with which the customer placed his order. Shipping costs will not be paid.

Subsequently, the customer will be provided by e-mail with the corresponding invoice document.

The customer wishes to cancel or modify his order:

If the order has not started processing, the customer will only have to inform about its modification or cancellation and will have no cost for it.

RMA exceptions:

The orders that consist of a customization (either in the modification of any of our illustrations or in the request for sizes greater than XXL in any of our T-Shirts) do not accept returns.

8.- APPLICABLE LEGISLATION AND JURISDICTION:

This website is regulated by the spanish law. The parties are submitted for the resolution of the conflicts and with resignation to any other jurisdiction, to the jurisdiction of the Courts and Tribunals of the Valencia city (Spain).
